La qualification par Israël de 6 grandes organisations palestiniennes d’« organisations terroristes » est une tentative de réduire au silence et de contrôler les Palestiniens

C’est par une attaque funeste, sans précédent et généralisée contre les défenseurs des droits humains palestiniens et les organisations de la société civile que le ministre israélien de la « Défense » Benny Gantz a annoncé, le 19 octobre 2021, la qualification de six principales organisations de la société civile palestinienne (OSC) comme « organisations terroristes », interdisant de facto ces organisations et les exposant à des risques de représailles imminentes.

Les six organisations désignées sont :

• Addameer (الضمير‎, « conscience » en arabe), soutien des prisonniers et défense des droits humains,
• Al Haq ( الحق, « le droit » en arabe), La loi au service de l’Homme,
• Le Centre Bisan pour la recherche et le développement,
• Défense pour les enfants Palestine-International,
• L’Union des comités de travail agricole (UAWC),
• L’Union des comités de femmes palestiniennes (UPWC).

Ces qualifications arbitraires s’attaquent à six des organisations de la société civile (OSC) et défenseurs des droits humains palestiniens les plus éminentes engagées dans un travail critique dans les Territoires palestiniens occupés (TPO). Elles visent aussi le travail de documentation et de suivi des violations des droits humains, de responsabilisation pour poursuivre les crimes de guerre et les crimes contre l’humanité d’Israël ainsi que les efforts juridiques et de plaidoyer pour mettre fin à l’occupation, au colonialisme de peuplement et au régime d’apartheid d’Israël. Ces qualifications sont une tentative inquiétante et sans précédent de la part des autorités d’occupation israéliennes à réduire au silence et à criminaliser les OSC palestiniennes qui défient l’occupation militaire prolongée, la colonisation acharnée et l’apartheid de la Palestine par Israël.

Il est important de noter que l’utilisation d’une législation « antiterroriste » volontairement vague et sans fondement pour criminaliser ces six organisations selon le droit israélien fait suite à des années de campagnes et d’attaques soutenues et systématiques contre les OSC palestiniennes. Il s’agissait pour Israël de contrecarrer leur travail de documentation sur les droits de l’homme et leurs coopérations internationales ainsi qu’avec les mécanismes des droits de l’homme des Nations Unies (ONU). Le 19 août 2021, la Rapporteuse spéciale des Nations Unies sur la situation des défenseurs des droits humains, Mary Lawlor, a publié une déclaration traitant de plusieurs cas importants d’arrestations arbitraires, de harcèlement, de criminalisation et de menaces contre les défenseurs des droits humains dans les TPO.

Ces qualifications reflètent des décennies de tentatives israéliennes pour contrôler le peuple palestinien. Elles servent à museler et à dégrader davantage le fonctionnement indépendant des OSC palestiniennes. Elles représentent en particulier une application illégale autant qu’odieuse du droit israélien aux TPO ; une application en violation de l’article 43 du Règlement de La Haye (1907) et du droit inaliénable et reconnu internationalement du peuple palestinien à l’autodétermination.

Au vu de la gravité de la situation actuelle et des risques imminents auxquels sont confrontés les acteurs humanitaires et les défenseurs des droits humains palestiniens, le PNGO et le PHROC appellent instamment la communauté internationale, c’est-à-dire l’ensemble des États, les organisations de la société civile, les défenseurs des droits humains, les Nations Unies et le grand public à :

1. exiger qu’Israël abroge sa qualification d’« organisation terroriste » contre les six principales OSC palestiniennes ;
2. dissuader les ministères israéliens de la Défense et de la Justice ainsi que tout autre interlocuteur concerné à cesser d’employer des pratiques illégales ainsi que des politiques d’intimidation et de harcèlement qui violent les conventions fondamentales du droit international comme la criminalisation arbitraire, le harcèlement et la répression des OSC palestiniennes ;
3. publier une déclaration de non-reconnaissance de ces qualifications en tant qu’acte illicite reconnu internationalement d’apartheid comprenant des mesures législatives visant à violer le droit à la liberté d’opinion et d’expression ainsi que le droit à la liberté de réunion pacifique et d’association ;
4. condamner ces qualifications comme une application illégale du droit israélien au territoire palestinien occupé ; et
5. appeler la communauté internationale, les donateurs, les sympathisants et les acteurs des droits humains du monde entier à condamner ces qualifications arbitraires et ces tactiques d’intimidation ainsi qu’à réitérer publiquement leur soutien aux organisations de la société civile palestinienne.

PNGO & PHROC: Israel’s Sinister Designation of 6 Leandig Palestinian Organizations As “Terror Organizations” is an Attempt to Silence and Control Palestinians

In a sinister, unprecedented, and blanket attack on Palestinian human rights defenders and civil society organizations, Israel’s “Defense” Minister Benny Gantz announced, on 19 October 2021, the designations of six leading Palestinian civil society organizations (CSOs) as “terror organizations,”effectively outlawing the organizations and placing them at risk of imminent reprisals. The six targeted organizations are: 

Addameer Prisoner Support and Human Rights Association, 

Al-Haq Law in the Service of Man (Al-Haq),  

Bisan Center for Research and   Development, 

Defense for Children International-Palestine (DCI-P), 

the Union of Agricultural  Work Committees (UAWC),

the Union of Palestinian Women’s Committees (UPWC).

The arbitrary designations target six of the most eminent Palestinian CSOs and human rights defenders engaged in critical human rights work in the Occupied Palestinian Territory (OPT), including the documentation and monitoring of human rights violations, accountability work to  prosecute Israel’s war crimes and crimes against humanity, and legal and advocacy efforts to bring Israel’soccupation, settler-colonialism and apartheid regime to an end. The designations represent an unprecedented and ominous attempt by the Israeli occupying authorities to silence and criminalize Palestinian CSOs that challenge Israel’s prolonged military occupation, entrenched settler-colonisation and apartheid of Palestine.

Notably, the use of purposely vague and baseless “anti-terrorism” legislation to criminalize the six organizations under Israeli domestic law follows years of sustained and systematic campaigns and attacks against Palestinian CSOs, to stymie their human rights documentation and cooperation with international and United Nations (UN) human rights mechanisms. On 19 August 2021, the UN Special Rapporteur on the situation of human rights defender, Mary Lawlor, issued a statement addressing multiple prominent cases of arbitrary arrests, harassment, criminalization, andthreats against human rights defenders in the Occupied Palestinian Territories (OPT).

The following designations reflect decades of Israeli attempts to control the Palestinian people and serve to further muzzle and decimate the independent functioning of Palestinian CSOs.

In particular, the designations represent an egregious and unlawful application of Israeli domestic law to the OPT, in violation of Article 43 of the Hague Regulations (1907) and the Palestinian peoples’ internationally-enshrined and inalienable right to self-determination.

Noting the gravity of the current situation and imminent risks faced by Palestinian humanitarian actors and Palestinian human rights defenders, PNGO & PHROC urgently call on the international community, including third States, civil society organizations, human rights defenders, the United Nations, and the broader public, to:

1.     Demand that Israel revoke its designation of “terrorist organization” against the six leading Palestinian CSOs;

2.     Urge the Israeli Ministry of Defense and Justice, and other relevant interlocutors to cease the employment of illegal practices and policies of intimidation and harassment, including the arbitrary criminalization, harassment, and repression of Palestinian CSOs, which violate fundamentalconventions under international law;

3.     Issue a public statement of non-recognition of the designations as an internationally wrongful act of apartheid, comprising legislative measures calculated to breach the right to freedom of opinion and expression, and the right to freedom of peaceful assembly and association;

4.     Condemn the designations as an unlawful application of Israeli domestic law to the occupied Palestinian territory; and

5.     Call upon the international community, including donors, supporters, and human rights actors around the world to condemn the arbitrary designations and intimidation tactics, and to publicly reiterate their support of the Palestinian civil society organisations.

الاحتلال اساس الارهاب والمؤسسات الاهلية نماذج للعمل المهني وفق القانون الفلسطيني

تعقيبا على ما تم تناقله ظهر اليوم الجمعة 22/10/2021 نقلا  عن ما يسمى « وزارة قضاء » الاحتلال استنادا لقرار ما يسمى « وزير جيش » الاحتلال بيني غانتس القاضي بتصنيف ستة منظمات أهلية على أنها منظمات « ارهابية » تؤكد  شبكة المنظمات الاهلية ان الاحتلال هو أحد اشكال الارهاب بما يمثله من ممارسات وجرائم بحق الشعب الفلسطيني، وسياسات الاستيطان الاستعماري، والتطهير العرقي بحق المدنيين العزل  والحصار وتصاعد الاعتداءات التي يقوم بها في كل الارض الفلسطينية .

إن شبكة المنظمات الاهلية وهي تعتبر هذا القرار امتدادا لذات السياسة الهادفة لكسر ارادة شعبنا ومنظماته الاهلية، وثنيها عن مواصلة عملها، واستمرارا للمخطط الذي تقوم به دوائر تابعة لدولة الاحتلال تنشط في أمريكا، وأوروبا عبر ما يسمى (بالانجيو مونتور) تسعى لتقويض عمل المنظمات الأهلية وتجفيف مصادر تمويلها وتلفيق التهم بحقها، ومحاولات وسم عملها بالإرهاب فإن شبكة المنظمات الأهلية الفلسطينية تجدد رفضها لهذا القرار وكل القرارات والسياسات السابقة واللاحقة وتؤكد انها ستستمر بذات الرسالة، والأهداف التي تسعى لتحقيقها، ولن تخيفها مثل هذه القرارات او تزعزع من إيمانها، وعملها المهني والقانوني .

وتؤكد الشبكة أن مؤسسات لجان المرأة والعمل الزراعي، والضمير وبيسان، والحركة العالمية للدفاع عن الاطفال، والحق هي مؤسسات فلسطينية أصيلة انبثقت من الحاجة الماسة في تعزيز صمود شعبنا والدفاع عن حقوقه ومواجهة انتهاكات الاحتلال  وفضح انتهاكاته ودعم حقوق الفئات والقطاعات التي تعمل معها، وهي لا تحتاج لأمر الاحتلال لاستمرار علمها، وما يحكم عملها هو القانون الفلسطيني، واستمرار أداء رسالتها تجاه الشعب الفلسطيني، وهي منظمات أهلية أعضاء في شبكة المنظمات الأهلية ولها بصماتها في خدمة أبناء شعبنا الفلسطيني، ولن تتعاطى مع هذا القرار الجائر .

كما تؤكد الشبكة انها ستشرع بحملة واسعة على كافة المستويات مع المؤسسات الدولية، والإقليمية الصديقة لفضح جرائم الاحتلال كما ستتابع على المستوى القانوني كل الحيثيات المتعلقة باستهداف العمل الأهلي على مدار السنوات الماضية، والتي شهدت ارتفاعا ملحوظا خلال العامين الماضيين سواء باقتحام العديد من المؤسسات، ووضع قرارات إغلاق بحقها وهي تقع في قلب المناطق المصنفة « ج  » الأمر الذي يتطلب من الجهات الرسمية التحرك العاجل من أجل مواجهة هذه الاجراءات الاحتلالية، والضغط دوليا لوقفها .

إن الشبكة وهي تحذر من تداعيات هذا القرار الخطير فإنها ستقوم بتفعيل جميع الآليات، والقنوات القانونية اللازمة على كل المستويات، وستحرك الملف لدى دول الاتحاد الاوروبي، والائتلافات الدولية انطلاقا من ايمانها بان هذه الهجمة الاحتلالية هي جزء من مخطط واسع يهدف لإنهاء عمل، ودور المنظمات الأهلية خصوصا تلك التي تعمل في المناطق المصنفة « ج » والمناطق المهمشة ومع القطاعات المتضررة، وتقديم البرامج ضمن البعد الحقوقي والقطاعات ذات العلاقة بما فيها العاملة في مجال حقوق الانسان والأسرى في سجون الاحتلال، وهي تؤكد بأن هذه الاجراءات لن تثنيها عن مواصلة هذا الدور رغم هذه الاجراءات الاحتلالية .
